HubLogiq is all about optimizing your fleet based on your criteria. We help you achieve more through telematics. In general, we build a black box into your vehicles, connect it to our cloud platform and display the collected (vehicle) information you need. To do this, we collect and use your data. In doing so, we value your privacy. Because this is your data, we believe that you can control how your data is used and by whom. That is why we have stated this privacy policy. We invite and encourage you to read this policy to understand how we work with personal data.

Our Privacy Principles And Promises

  1. We try to be fully transparent and as clear as possible about your privacy. If you have any questions, comments or concerns, please contact us at: privacy@hubLogiq.nl.
  2. We will keep you informed at all times. We will always keep you fully informed about your data. We make sure you understand what data from or about you we use, where we keep it, why we use it, how long we use it, and who can use it.
  3. We enable you to maintain control over your data. We consider the data that relates to you to be your data. We use this data only for the purposes for which you have given us permission or the purpose for which we collected it from you. You can opt-out or opt-in at any time in our software applications and on our websites.
  4. We protect your data. Your data belongs to you. We keep it that way by protecting this data at all times to prevent it from falling into the wrong hands.
  5. The area in which we operate. We operate according to the privacy laws that apply in your country. Because we are rooted in Europe, European privacy laws apply. These laws are considered the most comprehensive in the world. They provide you with a high level of protection by allowing us to use your data only if the strict conditions of these laws are met. Our company policy on privacy and processing of personal data reflects these laws and we apply this policy worldwide. The countries we target are Austria, Belgium (Flemish) / (French), Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and the United Kingdom.
  6. We will only use your data for the purposes we have mentioned to you. If we ask for your consent to use your data for specific purposes, we will also allow you to withdraw your consent. We will allow you to review and correct your data. We will keep as little data as possible and only for as long as we need it. When we no longer need data, we will destroy it, block access, and anonymize it, in both cases this data will therefore no longer be linked to you. If we engage third parties to use your information on our behalf, we will ensure that they act in accordance with our policies. If we share your information with third parties, we will ask you for permission first, unless there is a legal obligation that prohibits us from asking.

HubLogiq's Privacy Policy and Processing of Personal Data

1. Provisions

“HubLogiq” – when we say HubLogiq or “we” or “us”, we are referring to all of our communications on which a link to this policy appears, such as our websites, software and mobile applications.

“Services” means our website at https://hubLogiq.com (the “Site”), all related websites and mobile applications (including tablet applications) and other services provided by us on which a link to this Privacy Policy is displayed, and all other communications with individuals via written or oral communications, such as email or telephone.

“Black box” means HubLogiq hardware installed in a vehicle that collects and outputs technical and/or digital data, which may or may not be linked or read remotely, thereby collecting personal data, including tachograph data, about a driver’s trips from, use of a vehicle, activity and timekeeping.

“Customer” means a customer or partner of HubLogiq.

“Customer Data” means personal data, reports, addresses and other files, folders or documents in electronic form that a Service User maintains within the Services.

“Driver” means a person, employee or co-driver, authorized by the Customer for administrative purposes of the Service and/or who drives a vehicle equipped by a Black box.

“Partner” means a business partner of HubLogiq.

“Personal Data” means any data or information relating to an identified or identifiable natural person.

“Public area” means the portion of the site that can be viewed by both Users and visitors, without the need to sign in.

“Restricted Area” means the portion of the Site that is accessible only to Users and where access is required to log in.

“User” means an employee, agent or representative of a Client who primarily uses the restricted areas of the Site to access the Service in that capacity.

“Visitor” means a person other than a User, who uses the public area, but does not have access to the restricted portions of the Site or Service.

2. The information we collect through our Services

The legal basis for HubLogiq’s processing of personal data is that the processing is necessary for the provision of the Services in accordance with HubLogiq’s Terms of Service and Service Agreement and that the processing is carried out in HubLogiq’s legitimate interests, which are further explained in the “How do we use the information we collect” section of this policy. We may also process data if you have given your explicit consent to do so.

  • Services-related diagnostics;
  • Vehicle usage data such as: distance traveled, time of day, vehicle, driving speed, engine speed, engine load (number of hours), engine temperature, braking / cornering / acceleration, mileage, travel time and distance, vehicle consumption, tire pressure, cruise control, vehicle tire position, diagnostic trouble codes, axle load, battery voltage, braking distance, distance to services, fuel level, total vehicle weight, PTO data, retarder data;
  • Driver data (card data) via a tachograph, such as: card number, issue date, expiration date, first name, last name, date of birth, driver’s license number, country of origin and type of activity.

2.1 Information Provided by the User.

When you use the Services, either as a User or as a Visitor, you may indicate this and we may collect Personal Data as stated above. You may provide us with Personal Information through our Services in a variety of ways, such as when you register to obtain a white paper, use the Services, publish Customer Information, communicate with other Users of the Services through communication or messaging options, or send us tickets.

2.2 Information Collected by Customers.

A Customer or User may store or upload data to the Services. Digital data generated or processed by a Black box installed by or on behalf of the Customer and connected to a Driver is also information collected by Customers.

HubLogiq has no direct relationship with the individuals and Directors who are not Users of the Services and whose Personal Data it hosts as part of Customer Data.

Each Customer is responsible for notification to the Driver and third parties regarding the purpose for which the Customer collects its Personal Data and how such Personal Data is processed in or through the Services as part of Customer Data. A Customer or User has access to a Driver’s Personal Data only for the purpose of using and relating to the Services.

2.3 "Automatically Collected" Information.

When a User or Visitor uses the Services, we may automatically collect certain information from the User’s or Visitor’s device by using various types of technology, including cookies, “clear gifs” or “web beacons.” This “automatically collected” information may include an IP address or other device address or ID, web browser and/or device type, the web pages or sites accessed just before or just after using the Services, the pages or other content the User or Visitor views or interacts with on the Services, and the dates and times of visit, access to or use of the Services. We may also use these technologies to collect information about a Visitor’s or User’s interaction with email messages, such as whether the Visitor or User opens, clicks or forwards a message. This information is collected from all Users and Visitors

2.4 Information from Other Sources

We may obtain information, including personal information, from third parties and sources other than the Services, such as our partners, advertisers, rating agencies and integrated services. If we combine or link information from other sources with Personal Data we collect through the Services, we will treat the combined information as Personal Data in accordance with this Privacy Policy.

3. How we use the data we collect.

We use the information we collect in various ways in providing the Services and in operating our business, including:

3.1 Processing

We use the information – excluding Customer Data – to operate, maintain, improve and provide all features of the Services, to provide the services and information you request, to respond to comments and questions and to support Users of the Services. We process Customer Data only in accordance with the instructions of the respective Customer or User. The only Customer Data we process manually relates to handwritten notes or letters and contracts signed in writing.

3.2 Improvements

We use the information to understand and analyze the usage trends and preferences of our visitors and Users, to improve the Services and to develop new products, services, performance and functionalities. If this requires HubLogiq to process client data, the data will only be used in anonymized or aggregated form.

3.3 Communication

We may use a Visitor’s or User’s email address or other information – other than Customer Data – to contact that Visitor or User (i) for administrative purposes such as customer service, to report intellectual property violations, right to privacy violations or defamation matters related to the Customer Data or Personal Data posted on the Services or (ii) to inform you about promotions and events related to products and services services offered by us and by third parties with whom we partner. You have the option to opt-out of receiving promotional communications as described below in the “Your Choices” section.

3.4 Cookies And Tracking Technologies

3.4.1 What are cookies?

Cookies are small files stored on a User’s computer. They are designed to contain a modest amount of data specific to a particular Client and website and can be accessed by the web server or client computer. This allows the server to deliver a page tailored to a specific User, or the page itself may contain a script that is aware of the data in the cookie and can therefore carry information from one visit to the website (or related site) to the next.

3.4.2. Our cookie use

We use automatically collected information and other information collected on the Services through cookies and similar technologies to: (i) personalize our Services, such as remembering a User’s or Visitor’s information so that the User or Visitor does not have to re-enter it during a visit or on subsequent visits; (ii) provide customized advertisements, content and information; (iii) monitor and analyze the effectiveness of Services’ and third parties’ marketing activities; (iv) monitor aggregate site usage statistics, such as total number of visitors and pages viewed; and (v) track your logins, requests and status in any promotion or other activities on the Services. 3.5 Analytics

We use Google Analytics to measure and evaluate access to and traffic on the public and restricted areas of the site, and to create user navigation reports for our site administrators. Google operates independently from us and has its own privacy policy, which we strongly recommend you read. Google may use information collected through Google Analytics to evaluate User and Visitor activity on our Site. See Privacy and data sharing of Google Analytics for more information.

We take measures to protect the technical information collected through our use of Google Analytics. The data collected is only used based on the need to resolve technical issues, administer the Site, and identify Visitor preferences; but in this case, the data will be in non-identifiable form. We do not use this information to identify Visitors or Users.

We also use Analytics with Google Adwords for remarketing and to track what products or pages a visitor views or whether the visitor made a purchase / request based on one of our advertisements. In this way, we can measure how successful our marketing campaigns are and to what extent our offer connects with our target group. These cookies can also ensure that our ads on third-party websites are tailored to visitors’ interests, pages viewed or are offered with interesting offers.

These cookies are not personally identified and do not know who you are (name), nor what your address or email address is.

3.6 Sharpspring

We use the marketing automation tool Sharpspring to improve the Services and promotional communications. To use certain features of the Services, you will be asked to provide Sharpspring with access to certain personally identifiable information.

Personal information includes, but is not limited to, the following categories:

Contact information (such as your name, phone number, mailing address and email address);
Demographic information (such as your gender and zip code);
Third Party Social Media Accounts Data.
Sharpspring may supplement your personal information with information obtained from lawful, public third-party sources. See also Sharpspring’s privacy policy here.

3.7 Pipedrive

We use the pipeline management tool Pipedrive to manage and improve our staff’s marketing and sales processes. In order to use certain features of these services, we may use your personal information such as name and email address in this software solution. See Pipedrive’s privacy policy here.

3.8 Social Media Features

Our Sites may contain social media functions such as LinkedIn and Facebook, which are implemented on our Sites. These features may collect your IP address, what page you are visiting on our Sites, and may set a cookie for the feature to work correctly. Social media features and widgets are hosted by a third party or hosted directly on our Sites. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policies and other policies of the companies that provide these features.

4. Who we provide information to

Except as described in this policy, we will not intentionally disclose to third parties the personal information or Customer Data that we collect or store in our Services without the consent of the visitor, User or Customer. We may disclose information to third parties if you consent, as well as in the following circumstances:

4.1 Unrestricted Information

Any information that you voluntarily choose to include in a public area of the Services, such as a public profile page, is available to any visitor or User who has access to that content.

4.2 Service Providers

We may engage third-party companies to perform services on our behalf (for example, service providers that provide websites, application development, hosting, email, software maintenance, and other services). These third parties may have access to, or process, personal information or Customer Data as part of providing these services. We limit the information provided to these service providers to the extent reasonably necessary to perform their functions, and our contracts with them require them to maintain the confidentiality of such information. They are not authorized by us to otherwise use or disclose your personal information, except to the extent required by law.

4.3 Non-Personally Identifiable Information

We may make certain automatically collected, aggregated or otherwise non-personally identifiable information available to third parties for various purposes, including (i) compliance with various reporting requirements; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding the interests, habits and usage patterns of our Customers, Users and Visitors for certain programs, content, services and/or functionalities available through the Services.

4.4 Law Enforcement, Legal Processes And Compliance

We may disclose Personal Data or other information if required to do so by law, or in the sincere belief that such action is necessary to comply with applicable law, in response to a court order, judicial or other governmental request or order, or to otherwise cooperate with law enforcement or other governmental authorities.

We also reserve the right to disclose Personal Data or other information that we believe in good faith is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive or unlawful use or activity , (iii) notify us and defend us against claims or accusations made by third parties, (iv) protect the security or integrity of the Services and any facilities or equipment used to make the Services available, or (v) protect our property or other legal rights, enforce our contracts or protect the rights, property or safety of others.

4.5 Change of Ownership (Transfer of Ownership)

Information about Users and visitors, including personal data, may be disclosed and otherwise transferred to an acquiring party, successor or assignee as part of a merger, acquisition, debt financing, sale of assets or similar transaction, as well as in the event of an insolvency, bankruptcy or receivership in which information is transferred to one or more third parties as one of our assets and only if the recipient of the User or visitor data commits to a privacy policy that is substantially similar to this Privacy Policy.

Customer Data may be physically or electronically transferred to an acquiring party or to a successor or assignee as part of a merger, acquisition, debt financing, sale of assets or similar transaction, as well as in the event of insolvency, bankruptcy or receivership, information may be transferred to one or more third parties as one of our business assets for the sole purpose of continuing the operation of the Services, and only if the recipient of the Customer Data commits to a Privacy Policy that contains terms that are substantially consistent with this Privacy Policy.

5. Your Choices

5.1 Access, Modification and Deletion

You may choose not to offer or refuse to share certain Personal Information, even though this may affect your ability to register or receive the operation of certain features and functionalities of the Services.

If you do not wish to receive interest-based advertisements, you may opt-out as discussed in the “Internet-Based Advertisements” section.

We provide you with access to the personal information you may have provided through your use of the Services. If you would like to access or make changes to any other personal information we may have about you, please contact us as set forth in the “Contact Us” section. At your request, we will remove, anonymize or block any reference to you in our database.

You may update, correct or delete your account information and preferences at any time by going to the Account Settings page on the Services. Please note that although any changes you make will be reflected in active user databases immediately or within a reasonable time, we will retain any information you submit for backups, archiving, fraud and abuse prevention, analysis, satisfaction of legal obligations, or where we otherwise reasonably believe we have a legitimate reason to do so.

You may object to the processing of your personal data at any time, on legitimate grounds, except where otherwise permitted by applicable law. If you believe there has been a breach of your right to privacy granted by applicable data protection laws, please contact HubLogiq’s Privacy Department at privacy@hublogiq.com. You also have the right to file a complaint with data protection authorities.

This provision does not apply to personal data that is part of Customer Data. In this case, the management of Customer Data is subject to Customer’s own Privacy Policy, and any request for access, correction or deletion should be made to the Customer responsible for uploading and storing such data in the Services.

In this case, the management of Customer Data is subject to Customer’s own Privacy Policy, and any request for access, correction or deletion must be made to the Customer responsible for uploading and storing such data in the Services.

5.2 Navigation Information.

You may opt-out of the collection of navigation data about your visit to the Site by Google Analytics Opt-out feature.

5.3 Unsubscribing from Commercial Communications.

If you receive commercial emails from us, you may opt-out at any time by following the instructions in the email or by sending an email to the address listed in the “Contact Us” section.

Users can view and change settings related to the nature and frequency of promotional communications they receive from us by going to the “My Settings” tab on the Services.

Please note that if you opt out of receiving commercial e-mail from us or otherwise will change the nature or frequency of the promotional communications you receive from us, it may take up to ten (10) business days for us to process your request. In addition, even after you have opted out of receiving commercial communications from us, you will continue to receive administrative communications from us regarding the Services.

HubLogiq has no direct relationship with Customer Customers or any third party whose Personal Data it may process on behalf of a Customer. An individual seeking access or attempting to correct, amend, delete inaccurate data or withdrawing consent for further contact should address their query directly to the Customer or User with whom they are doing business. If the Customer requests HubLogiq to delete the data, we will respond to their request within thirty (30) days. We will only delete, modify or block access to personal data we store if we receive a written request from the Customer responsible for such personal data, unless we have a legal right to retain such personal data. We reserve the right to retain a copy of such data for archiving purposes, or to defend our rights in litigation. Any such request regarding Customer Data must be handled as indicated in the “Contact Us” section and must include sufficient information for HubLogiq to identify the Customer or its Customer or third party and the information to be deleted or modified.

Third Party Services. The Services may contain features or links to websites and services provided by third parties. Any information you provide about third party sites or services is provided directly to the operators of such services and is subject to that operator’s policies, if any, governing privacy and security, even if accessed through the Services. We are not responsible for the content or privacy and security practices and policies of any third party sites or services services linked to or accessed through the Services. We encourage you to learn more about the privacy and security policies of third parties before providing any information.
Interest-Based Advertising. Interest-based advertising is the collection of data from various sources and on various platforms to predict a person’s preferences or interests and to deliver to that person, or his/her computer, smartphone or tablet advertising based on his/her assumed preferences or interest derived from the collection of data related to that person or others who have a similar profile or interests.

We work with a variety of third parties to understand the profiles of the individuals most likely to be interested in HubLogiq products or services so that we can send them emails for promotion, or serve our ads to them on the websites and mobile devices. apps of other entities.

These third parties include: (a) ad networks, which collect information about a person’s interests when that person views or interacts with one of their ads; (2) attribution partners, which measure the effectiveness of certain ads; and (3) business partners, which collect information when a person views or interacts with one of their ads.

In conjunction with these third parties, we collect information about our Customers, prospects and other individuals over time and across various platforms when they use or interact with those platforms. Individuals may submit information directly on our sites or on third-party platforms, or through interaction with us, our advertisements or emails they receive from us or from third parties. We may use special tools commonly used for this purpose, such as cookies, beacons, pixels, tags, mobile ad IDs, flash cookies and similar technologies. We may have access to databases of information collected by our business partners.

The information we or third parties collect allows us to learn what purchases the person has made, what ads or content the person sees, what ads or links the person clicks on, and other actions the person takes on our Sites, or in response to our emails or when visiting or using third-party platforms.

We, or the third parties we work with, use the information collected as described above to understand the various activities and behaviors of our Customers, Site visitors and others. We, or these third parties, do this for many reasons, including: to recognize new or past visitors to our Sites; to present more personalized content; to provide useful and more relevant advertising. For example, if we know what ads you are seeing, we can try not to show you the same ones over and over again; to identify visitors on different devices, sales channels, websites and third-party sites, or to display or send personalized or targeted ads and other customized content that is more focused on someone’s perceived interest in products or services types similar to those we offer.

Our interest-based advertisements may be delivered to you in emails or on third-party platforms. We may serve these ads about our products or service types or send commercial communications directly ourselves or through these third parties.

Visitors may choose to receive interest-based advertisements by ad networks that may be delivered on their platform and other websites by going to the website http://www.youronlinechoices.com/. These features will select a Visitor from many – but not all – of the interest-based advertising activities in which we or third parties engage.

8. Cookies We Use on the Website

  1. Strictly necessary / essential cookies – These cookies are essential to enable you to move around the website and use its features, such as accessing secure areas of the website. Without these cookies, the services you have requested cannot be provided. These cookies do not collect information that identifies a Visitor.

Performance Cookies – These cookies collect information about how Visitors use a website, for example, which pages Visitors go to most often and whether they receive error messages from web pages. These cookies do not collect information that identifies a Visitor. All information these cookies collect is aggregated and therefore anonymous. It is only used to improve the operation of a website.
  3. functionality cookies – These cookies allow the website to remember choices you make (such as your user name, language or the region you are in) and provide enhanced, more personalized features. For example, a website may provide you with local weather or traffic news by storing in a cookie the region where you are currently located. These cookies may also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customize. They may also be used to provide services you have requested, such as viewing a video or commenting on a blog. The information these cookies collect can be anonymized and they cannot track your browser activity on other websites.
  4. behaviourally targeted advertising cookies – These cookies are used to deliver ads that are more relevant to you and your interests. They are also used to limit the number of times you see an ad and to measure the effectiveness of ad campaigns. They are usually placed by ad networks with the permission of the website owner. They remember that you have visited a website and this information is shared with other organizations, such as advertisers. Often targeting or advertising cookies are linked to site functionality provided by the other organization.
  5. Data retention. We retain personal information collected by a User only for as long as the User’s account is active or otherwise for a limited period of time as we need it to accomplish the purposes for which we originally collected it, unless otherwise required by law. We retain and use information as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements as follows: at the Customer’s request, we delete or anonymize all personal information.

11. Settings

While we may allow you to customize your privacy settings to limit access to certain personal information, please note that no security measure is perfect or impenetrable. We are not responsible for circumvention of privacy settings or security measures on the Services. In addition, we cannot control the actions of other Users with whom you may wish to share your information. Further, even after information on the Services is deleted, coaching and archiving Services may have stored that information, and other Users or third parties may have copied or stored the information on the Services. We cannot and do not guarantee that information you post or transmit on the Services will not be viewed by unauthorized persons.

12. Data controller and data processor

HubLogiq does not own, control or direct the use of Customer Data stored or processed by a Client or User through the Services. Only the Client or Users are entitled to access, retrieve and use such Customer Data. HubLogiq is largely unaware of what Customer Data is actually stored or made available by a Client or User to the Services and has no direct access to such Customer Data, except as authorized by the Client, or as necessary to provide Services to the Client and its Users.

Because HubLogiq does not collect or determine the use of personal data in the Customer Data and because HubLogiq does not determine the purpose for which such personal data is collected, the means of collecting such personal data or the use of such personal data, HubLogiq is not acting in the capacity of a data controller in terms of the European Union’s General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter “GDPR”) and does not have the corresponding responsibilities under the AVG. HubLogiq may only be considered a processor on behalf of its Customers and Users with respect to Customer Data containing Personal Data subject to the requirements of the GDPR. Except as provided in this Privacy Policy, HubLogiq does not independently ensure that Customer Data containing Personal Data stored in connection with the Services is transferred or otherwise made available to third parties, except to third party subcontractors who may process such data on HubLogiq’s behalf in connection with HubLogiq’s provision of Services to Customers. Such actions will only be performed or authorized by the applicable Customer or User.

The Customer or User is the data controller under the Regulation for Customer Data containing Personal Data, meaning that such party controls the manner in which such Personal Data is collected and used, as well as the determination of the purposes and means of processing such Personal Data.

HubLogiq is not responsible for the content of the Personal Data included in Customer Data or other information stored on its servers (or the servers of its subcontractors) at the discretion of Customer or User, nor is HubLogiq responsible for the manner in which Customer or User otherwise collects, handles, distributes or processes such information.
